Like Conservatorship, the Georgia Probate Courts may also grant Guardianship of an adult resident found by the Court to lack sufficient capacity to make or communicate significant responsible decisions concerning his or her health or safety. Proper planning and preparation allows you to make that decision for yourself ahead of time and avoid Probate Court.
Guardianship is also required when your minor child is left without both parents due to a tragedy. The nearest relative would file a petition in court to become legal guardian of your children.
